Before 1870, ministerial oversight of Justice was held by the Colonial Secretary. During the Provincial period 1852-1876, this oversight consisted of writing the laws related to justice and the appointment of senior members of the judiciary while the control of police, jails, sheriffs and coroners was held at the provinical level. It is assumed that due to the ongoing difficulties of running a judicial system on this divided basis that a separate portfolio was required to respond to the various Commissions and reports undertaken before the establishment of a separate department of Justice in 1872.

Establishment of this portfolio occurred after the creation of the Stamp Office under the Stamp Duties Act, 1866. The actual starting point of the offices was after an order in Council dated 22 February 1867. The first commissioner was appointed on 6 May 1867

New Zealand was the first country in the world to establish a government department for tourism. The government was originally involved in the direct provision of tourist amenities and travel services. After 1950, the focus shifted to promoting New Zealand as a tourist destination and providing incentives to encourage private enterprise. By the later part of the 20th century, the government had ceased providing facilities and was principally involved in promoting and regulating the tourist industry.
